Information you provide

We may collect information you choose to provide in connection with a loan inquiry or proposed real estate transaction, including:

• Identity and contact details, such as your name, date of birth, email address, telephone number, residential address, and mailing address;
• Personal and business profile details, such as borrower experience, borrowing entity information, and proposed title or vesting;
• Property and transaction details, such as property address, property type, purchase price, target closing date, requested financing, project purpose, and exit strategy;
• Existing financing details, including current loan balances, payment information, and lender information;
• Rental and property-operating details, including current or projected rent, lease status, occupancy, taxes, insurance, and homeowners association information;
• Rehabilitation, construction, and valuation details, including estimated rehabilitation costs, project budget, as-is value, after-repair value, and supporting property information;
• Refinance and cash-out details, including requested cash-out proceeds and the intended business purpose for those proceeds; and
• Typed names, acknowledgments, certifications, authorizations, and electronic signatures submitted with an inquiry or application.

We may also receive documents and other information you voluntarily provide as we evaluate or process a financing request.

Sensitive information not requested through the public inquiry

Our short website inquiry and the separate portal loan application do not request Social Security numbers, online-banking credentials, bank-account login information, or payment-card information. Do not submit those items through either form or by ordinary email. If sensitive information is needed later, we will provide instructions for an appropriate collection method.

Automatic information, cookies, analytics, and pixels

When you use the website, our hosting and security providers may automatically process information such as your IP address, device and browser type, operating system, referring page, pages requested, access times, and server-log or security-event data. This information helps deliver the website, maintain security, diagnose errors, and prevent abuse.

This website uses first-party aggregate measurement to understand which public pages and helpful actions people use. It counts page views, starting and successfully submitting an inquiry, clicks toward the loan application or email, article-to-inquiry clicks, newsletter form views and starts, accepted newsletter confirmation requests, and confirmed subscriptions. Each stored counter contains only the calendar day in America/Chicago, an approved public page path, an event category, a broad source category (direct, search, social, referral, email, or internal), and a count. No names, email addresses, form answers, IP addresses, device identifiers, visitor or session IDs, raw referring URLs, confirmation tokens, or query strings are stored in these activity counters. Confirmation and unsubscribe pages are excluded from public page measurement.

Aggregate measurement does not use analytics cookies, persistent visitor identifiers, advertising pixels, cross-site tracking, or individual browsing histories. Repeat visits and actions may be counted again; these are not unique-visitor statistics. We respect browser Do Not Track and Global Privacy Control signals by excluding those requests from our aggregate measurement. Known automated crawlers and marked audit traffic are also excluded where identifiable. Referring pages are classified into broad categories without retaining their URLs; email sources may be indistinguishable from direct visits when no referrer is provided.

Essential cookies or similar technologies may be used by hosting and security providers when necessary to operate or protect the website. The separate loan-application portal and its hosting and authentication providers may use cookies or similar technologies needed for sign-in, security, and operation. Aggregate activity reporting is separate from inquiry records, newsletter consent, and transactional communications. It does not add anyone to a marketing list. If these practices change, we will update this notice and provide any consent or choice required by applicable law.

How we use information

We may use information to respond to questions; evaluate, underwrite, document, close, service, or otherwise support a financing request; verify information and prevent fraud; communicate about a proposed or existing transaction; improve our website and services; maintain security and business records; enforce our agreements; protect legal rights; and comply with legal, regulatory, tax, accounting, and recordkeeping obligations.

Email, telephone, and text communications

If you provide contact information, we may use email, telephone calls, or text messages to respond to your request and communicate about an application, transaction, document request, closing, account, or other service-related matter. These are transactional communications, not marketing communications.

The Investor Brief is a separate, optional marketing email. We collect an email address, optional first name, signup source, and a record of affirmative consent only when someone checks the newsletter box and submits that form. A request remains pending until the recipient uses the confirmation email and confirms their choice. We maintain a confirmation-token record, its expiry, and confirmation and consent timestamps to support this process. Confirmation links expire; requesting a link alone does not enroll an address in the newsletter.

After confirmation, we send a welcome email containing Investor Brief Issue 01 and send regular editions every other Monday at 9 a.m. Central time. Loan inquiries, applications, and transaction updates do not enroll anyone, and newsletter signup is not a loan application. Subscribers may unsubscribe through the link in a marketing email or by emailing us. This does not stop necessary transaction or service emails. You may opt out of marketing text messages, if ever used, by replying STOP. Message and data rates may apply to text messages.

Forms and service providers

The short inquiry and newsletter signup are hosted on this website. Resend processes inquiry notification emails, newsletter confirmation and welcome emails, and the separate Investor Brief subscriber list and broadcasts. The loan application is provided through the separate Gustafson Capital portal; its hosting, authentication, storage, and communications providers may process application information to provide those services. We may use other service providers to host and secure the website, manage communications and records, prevent fraud, and support our business operations. These providers may process information for the services they perform for us.

How information may be disclosed

We may disclose information to service providers, professional advisers, capital providers or financing participants, title and closing professionals, appraisers, inspectors, insurance providers, property-related vendors, counterparties you direct us to involve, and government or regulatory authorities when reasonably necessary to evaluate or support a transaction, operate our business, protect rights or safety, detect fraud, or comply with applicable requirements. Information may also be disclosed with your direction or consent.

Sale and targeted advertising

As this public website is currently configured, Gustafson Capital does not sell personal information collected through it and does not share that information for targeted advertising or cross-context behavioral advertising. The website does not currently use advertising pixels. This statement is limited to the website practices described in this notice. If these practices change, we will update this notice and provide any rights or choices required by applicable law.

Business transfers

Information may be disclosed or transferred as part of an actual or proposed merger, financing, acquisition, sale of assets, reorganization, bankruptcy, receivership, or similar business transaction, subject to applicable law and appropriate confidentiality protections.

Third-party links and services

This website links to the separate Gustafson Capital portal and may link to other third-party websites or services. Gustafson Capital does not control third-party privacy, security, or content practices. Review the applicable third party's policies before providing information. A link does not by itself constitute an endorsement.

Retention and security

We retain information for as long as reasonably necessary for the purposes described in this notice, including transaction, underwriting, legal, compliance, dispute-resolution, fraud-prevention, tax, and recordkeeping needs. Retention periods may vary by the type of information and applicable obligations. We use reasonable administrative and technical safeguards, but no internet transmission or storage system can be guaranteed to be completely secure.

Your privacy choices and requests

Depending on your location and applicable law, you may request access to personal information we maintain about you, correction of inaccurate information, deletion of information, or a portable copy of information you provided.

To submit a request, email info@gustafsoncapital.co with the subject “Privacy Request” and describe the request. We may ask for information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where permitted by law, subject to verification of the agent's authority and, when appropriate, your identity.

We will respond within the period required by applicable law. A request may be limited or denied when information must be retained to comply with law, preserve transaction or business records, complete a contract, detect fraud or security incidents, establish or defend legal claims, or protect the rights of others. If we deny a request, you may email us with the subject “Privacy Appeal” and explain why you believe the decision should be reconsidered. We will not discriminate against you for exercising an applicable privacy right.

Children's privacy

This website is intended for adults seeking business-purpose real estate financing and is not directed to children. We do not knowingly request personal information from children through this website.
